‘Progress’ on liability and onus on proof

While aspects of reverse onus on proof remain in the Heavy Vehicle National Law, progress has been made on the transport industry’s chain of responsibility and executive officer liability concerns, a Queensland parliamentary committee was told today.

The public briefing of the Transport, Housing and Local Government Committee was told that the number of liable offences had been reduced in the national law’s amendment Bill and a blanket liability for those managing transport firms “no longer applies”.
