RMS sees hefty COR fine on Metropolitan Demolitions

Group and director fined $1.5 million on overloading after guilty plea


Inaccurate record keeping has led to a successful Roads and Maritime Services (RMS) prosecution of construction services firm Metropolitan Demolitions, it has emerged.

The Sydney construction services company and a director were fined $1.5 million and ordered to pay $50,000 in costs in the Local Court after pleading guilty, according to RMS.

The plea and the court involved mean the sentence was delivered orally and no written judgement was recorded, a court spokesperson tells ATN.

Asked about the case, RMS says it carried out an investigation and subsequent prosecution in relation to the overloading of heavy vehicles by the Metropolitan Demolitions Group.

“Companies Metropolitan Demolitions & Recycling Pty Ltd and Metropolitan Demolitions Pty Ltd as well as an executive officer each faced court for breaches of the Heavy Vehicle National Law under the Chain Of Responsibility provisions,” an RMS spokesperson says.

“The investigation carried out by Roads and Maritime revealed a work diary which recorded registration and weight details of heavy vehicles within the fleet for the period between August and December 2015.

“There were concerns the work diary failed to accurately record vehicle loads which were suspected to have exceeded the legal limits on multiple occasions.

“Magistrate Greenwood of the Downing Centre Local Court convicted the defendants of a total of 138 mass breach offences, three offences of knowingly providing false documentation and 14 executive officer offences.”

“Roads and Maritime Services regularly undertakes forums to engage industry around heavy vehicle speeding, container operations, safety and maintenance compliance and load restraint.”

RMS adds that a “supervisory intervention order has been made against the operator, and a prohibition order has been made against the director”.
