FWC approves NUW ballot at Toll facility

Union to hold ballot over proposed enterprise agreement dispute

 

A protected action ballot could be in the offing at Toll Transport’s Adidas facility in Truganina, Melbourne.

The Fair Work Commission (FWC) has given the National Union of Workers (NUW) approval to hold the ballot following disagreement with the company over a new proposed enterprise agreement.

FWC deputy president Peter Sams approved the union’s application after Toll confirmed that it did not oppose the action.

“I am satisfied that the application has been made in accordance with the requirements of s 437 of the Act [Fair Work Act 2009] and that the union is genuinely trying to reach an agreement with the employer of the employees who are to be balloted,” Sams says.

The union and the company are feuding over certain provisions in the new proposed agreement.

ATN is awaiting comment from both parties regarding details of the dispute.
