Cecil to lead safety summit look at executive liability

Holding Redlich lawyer Nathan Cecil will lead discussion at an upcoming Australian Logistic Council (ALC) conference on a range of Chain of Responsibility (COR) issues.

An ATN columnist, Cecil is a partner in Holding Redlich’s national transport team.

It is essential that executive officers understand the scope of their duties COR and what is required to discharge them, the ALC says.

"In NSW, executive officers, primarily directors, are the third highest prosecuted COR party," it adds.

"In addition and following the recent NTC review of executive officer liability, the compliance obligation imposed on executive officers is likely to be increased in the near future.

The ALC provided a submission on the Heavy Vehicle National Law – Extension of Executive Officer Due Diligence Obligation draft regulatory impact statement.  

Following the 2015 ALC Supply Chain Safety & Compliance Summit workshop session on COR board reporting, the ALC and Holding Redlich jointly developed a questionnaire on board reporting practices that was distributed to ALC members and other participants in the sector.

ALC is again dedicating a workshop session to these important issues at the upcoming 2016 Summit.

The session with Cecil will:

  • review the current executive officer due diligence and liability regime
  • summarise the outcomes of the NTC’s executive officer liability review
  • provide an overview of the new laws expected to arise from the NTC review
  • discuss what executive officers need to do to comply
  • review the response to the ALC/Holding Redlich questionnaire on board reporting practices
  • provide participants with recommendations on the COR compliance metrics that can be collected and should be reported to executive officers for each COR component.
