A company that failed to settle a bill of almost $80,000 with five owner-drivers has been given until September 22 to cough up the cash.
The NSW Industrial Relations Commission has ordered A&S Logistics to pay $79,422 to the sub-contractors, who recently won their case against the trucking operator.
The Transport Workers Union (TWU), which represented the owner-drivers, filed a small claims application on August 25 following the hearing.
"The payments…shall be made by 22 September 2011. Each Order…shall take effect on and from Thursday, 1 September 2011," Commissioner Alistair Macdonald says in his written judgement.
The sub-contractors were waiting in some instances for more than a month to get paid despite stipulating seven-day terms in their contracts with A&S. The money owed ranges from $11,000 to $24,156 (capped at $20,000).
A&S Director Shane Black repeatedly ignored requests to appear at pre-hearing conferences and was a no-show during the ruling. He had earlier this year promised to settle the accounts.
Owner-driver Luke Bickhoff complained that he had to wait 33 days to be paid despite Black promising to bring all invoices up to date.
"When I would approach Shane he would promise to deposit the monies into my account within days of speaking to him but this would never happen," another owner-driver, Tufiq Nabaki, says.
